To use PennyOS, you may be required to register and obtain a valid license key.
Licenses are issued through our management server. Unauthorized use or license sharing is prohibited.
You are responsible for safeguarding your license key and account credentials.
3. Self-Hosted vs. Managed Services
Self-Hosted: Most PennyOS functionality is hosted by you on your own infrastructure. You are solely responsible for securing, configuring, and maintaining your environment.
Management API: Some features (such as license activation, authentication, and bank integrations) connect to our management servers. You consent to these connections as part of using the Services.
We are not liable for outages, data loss, or security breaches resulting from your self-hosted deployment.
4. Acceptable Use
You agree not to use PennyOS for unlawful purposes (including money laundering, fraud, or unauthorized trading).
Attempt to bypass license restrictions or modify the Services without authorization.
Interfere with the operation of our management API or related services.
5. Fees & Payments
Certain features or licenses require payment. Pricing and billing details are provided separately.
Payments are non-refundable except as required by law.
Failure to pay may result in suspension or termination of your license.
6. Data & Third-Party Services
PennyOS integrates with third-party services such as Plaid (banking data) and Polygon.io (market data).
By using these integrations, you authorize PennyOS to access and process data from these providers.
We are not responsible for the accuracy, availability, or performance of third-party services.
7. No Financial Advice
PennyOS is a software platform only. We do not provide financial, investment, tax, or legal advice.
Any financial information, simulations, or trading bot strategies provided are for informational and educational purposes only.
You are solely responsible for any financial decisions made using PennyOS.
8. Trading Bots & Automation
If you use PennyOS to execute automated trading strategies, you assume full responsibility for any resulting trades, profits, or losses.
We are not responsible for missed trades, execution errors, or financial losses of any kind.
9. Open Source Licensing Alignment
Portions of PennyOS are made available under open-source licenses (e.g., MIT, Apache 2.0, GPL). These components are clearly identified in our repositories and documentation.
Your rights and obligations for open-source components are governed by the applicable open-source license, which may grant you rights beyond those stated in these Terms.
Proprietary components (including but not limited to the management API, license server, and certain trading or financial modules) remain subject to these Terms and are not covered by open-source licenses.
By using PennyOS, you agree to comply with all applicable open-source licenses.
In the event of a conflict between these Terms and an applicable open-source license, the open-source license will govern solely for the specific component under that license.
10. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind.
We do not guarantee accuracy of financial data or market information.
Continuous, error-free operation of the Services.
Any particular trading or financial outcome.
11. Limitation of Liability
To the maximum extent permitted by law: We are not liable for indirect, incidental, or consequential damages.
Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.
If you are using the free or open-source version, our liability is limited to $0.
12. Termination
You may stop using PennyOS at any time.
We may suspend or terminate your license or access if you violate these Terms.
13. Governing Law & Disputes
These Terms are governed by and construed under the laws of the State of New Jersey, United States, without regard to conflict of law principles.
Any disputes, claims, or legal proceedings arising out of or related to these Terms or the Services shall be brought exclusively in the state or federal courts located in New Jersey, United States.
You consent to the personal jurisdiction and venue of these courts.
14. Changes to These Terms
We may update these Terms from time to time.
If changes are material, we will provide notice (e.g., via email or within the app).
